here's what I'd answer if I were ol' hornhead.
"Geez Cap. You're the old Cap, right? The one who was top cop a while ago and put Wolverine on two avengers teams. Wolverine. The guy who kills bad guys left and right by getting snikty snikt. Who has become evil/brainwashed and used to go on a killing spree every other week-end. And... who did you give the mantle of captain America to before? Oh, that's right... Bucky. the ex-winter soldier who was a soviet brainwashed assassin and used killed people on american soil left and right.
And I'm to be arrested because I killed bullseye and got possessed by the hand while the rest of you watched as my life was gradually falling apart?!? And you also wanted to kill me during that time? Know what? %£/% &%£ &%£&£!!! I'm kicking your self righteous super-soldier ass from here to New Jersey just for having the face of telling me I'm under arrest" |

The Hand killed people left and right in Hells kitchen not to mention they already had enough of a track record when it came to murder (to the gov it's no different then if Matt was the leader of Hydra, they're both still organizations that commit major illegal felonies).
Matt himself murdered another man publically but what was worse was that he was a servant of the legal system and violated the law. Men with higher authority didn't like it so they want to take him in.
yeah i hate cap with a passion but he's just following the law and right now DD is still a bad guy in the eyes of the law until he redeems himself during Waids run.
(btw, we all know this is going to end well with both having a nice civil talk after the fighrt and each walking away with an understanding. Matt DOES become an Avenger after all....) |

maybe his upcoming "avenger" status is some kind of way to pay back to society?
avengers are employees these days.. they even get paid for being available as an avenger. I could imagine that cap wants him on the team, just to have an eye on DD, and give him a chance to redeem himself.

Having now read issue #2, this isn't too far removed from what actually happened.  |
